Competition Rules "Rate and Win"

1. Introductory Provisions

1.1 The purpose of these competition terms is to set binding rules on which the "Rate and Win" competition (hereinafter referred to as the "Competition") organised by the Organiser will be conducted.

1.2 The relations between the Organiser and the Competitors are governed by these Competition Terms.

2. Definitions of Terms Used

2.1 The competition is organised by Fantasy Cards s.r.o., with its registered office at Ondříčkova 2166/14, 130 00 Praha 3, ID: 24257478, VAT ID: CZ24257478 (hereinafter referred to as the "Organiser").

2.2 A Competitor is a person who participates in the Competition. By participating in the Competition, the Competitor agrees to the rules and conditions of the competition in full.

2.3 The Winner of the Competition is the User or Users who have met the conditions of the Competition. The winner is announced once a month, always by the 10th calendar day following the end of the given Competition period.

2.4 The Competition Announcement is the notification of the result of the Competition published by the Organiser according to the Competition rules and is governed by these Competition Terms.

2.5 The Start of the Competition is considered 1 August 2024.

2.6 The End of the Competition is not set, and the Competition lasts until it is terminated by the Organiser. The Competition duration is divided into individual Competition periods by months. The Competition period always starts on the 1st calendar day of the given month and ends on the last calendar day of that month.

2.7 The Prize of the Competition is vouchers for shopping at the e-shop www.najada.games and/or tangible prizes in the form of goods determined by the Organiser for the given Competition period.

3. General Rules

3.1 All Users who agree with these Competition Terms can participate in the competition, except for employees and collaborators of the Organiser and their family members.

3.2 Only a natural person over 18 years old or a person over 10 years old with a legal representative responsible for them during the competition and the realisation of the prize can participate in the competition.

3.3 By participating in the Competition, the Competitor agrees with the Competition Terms in full. Those who do not agree with these Competition Terms cannot participate in the competition.

3.4 A Competitor is included in the Competition for the given Competition period by completing the "Order Review'' questionnaire on the e-shop www.najada.games, which the User has time-limited access to from the completion of an order made through the Organiser's e-shop. The date of sending the questionnaire determines inclusion in the Competition, regardless of when the order was made or paid for. By fulfilling these conditions, the Competitor automatically participates in the Competition and thus becomes an active Competitor.

3.5 The Prize is handed over by the Organiser no later than 30 days from the determination of the Winner, either by personal collection, by email, or by courier to the delivery address provided by the Winner during the Prize notification communication by the Organiser. This fulfils the obligation to hand over the Prize to the Winner.

3.6 The Prize of a Competition participant, which for reasons not attributable to the Organiser cannot be delivered, forfeits to the benefit of the Organiser. The Organiser is not responsible for the loss, damage, destruction, or non-delivery of the Prize notification or the Prize itself due to reasons attributable to the Competition participant, electronic communication service provider, postal service provider, or other courier.

3.7 There is no legal entitlement to the Prize, and it cannot be exchanged for cash or any other compensation.

3.8 The Prize cannot be enforced by court.

4. Rights and Obligations of the Competitor

4.1 The Competitor declares that they participate in the Competition voluntarily.

4.2 The Winner is obliged to send the Organiser complete and truthful contact information necessary for obtaining and sending/handing over the prize.

4.3 The Competitor who becomes the Winner must respond to the Organiser's call within 7 working days. Otherwise, the right to the prize expires.

4.4 The Organiser will inform the Winner about the Prize via the email address provided by the Winner when placing the order on the Organiser's e-shop.

4.5 If the Winner does not respond to the call within 7 working days, the prize forfeits to the benefit of the Organiser. The Organiser reserves the right to designate a substitute Winner who will take the place of the original Winner who did not respond to the call.

4.6 The Competitor must behave in a way that does not violate the applicable laws of the Czech Republic and does not cause any harm to the Organiser or other Competitors by their actions.

5. Rights and Obligations of the Organiser

5.1 The Organiser must inform the Winner of the fact that they have become the Winner within 14 working days from the end of the given Competition period for which they became the Winner, via email. The Organiser selects two Winners for each Competition period. The Organiser decides how to distribute the Prizes to these Winners.

5.2 The Organiser fulfils their obligation to issue the Prize to the Winner by handing it over, either by personal delivery to the Winner at the Organiser's headquarters (Najáda store, Ondříčkova 2166/14, 130 00 Praha 3) or by sending it to the delivery address provided by the Winner or by sending it via email to the email address provided by the Winner.

5.3 The Organiser is not responsible for any damages that the prize may cause to the Winner or other persons who come into contact with the prize.

5.4 The Organiser reserves the right to change, suspend, or terminate the Competitions without providing reasons. In such a case, active Competitors are not entitled to any compensation or settlement.

6. Personal Data

6.1 By participating in the competition, the participant consents to the Organiser processing their personal data for the purpose of organising the competition and to the extent necessary for this purpose, including consent to their publication on the website in accordance with Act No. 101/2000 Coll. on the protection of personal data and Act No. 127/2005 Coll. on electronic communications, as amended. The participant also grants Fantasy Cards s.r.o. consent to send information about organised events and other activities, as well as commercial communications to the provided email address under Act No. 480/2004 Coll. on certain information society services until the consent is revoked in writing, for a period of three years unless revoked earlier. The Organiser is entitled to process the personal data provided by the competition participants for the duration of the competition and for a reasonable period after its conclusion, but no later than the end of the third month after the competition ends. The competition participant has the right to access their data, is entitled to request information about the personal data being processed about them, and in case of violation of their rights, can ask the competition organiser for an explanation or demand that the competition organiser rectifies the situation, or they have the right to contact the Office for Personal Data Protection. The participant acknowledges that they have rights under §§ 11 and 21 of Act No. 101/2000 Coll. on the protection of personal data, i.e., in particular, that providing personal data is voluntary, that they can revoke their consent at any time for free, that they have the right to correct data, block, and destroy them. The competition participant can revoke their above consents at any time by sending a written request to the above address of the company. However, in such a case, they lose the right to the Prize if the competition has not yet ended.

6.2 The Competitor hereby agrees to receive information about new competitions and promotional communications from the Organiser and third parties cooperating with the Organiser.

7. Final Provisions

7.1 These Competition Terms are created in accordance with the valid legislation, laws, and other legal regulations of the Czech Republic. The User confirms by their participation in the competition that they have been demonstrably acquainted with these conditions and agree to comply with them.

7.2 The Organiser has the right to change and/or supplement these Competition Terms.

7.3 The Organiser reserves the right to change the rules or conditions of the Competition at any time, including changing its duration or terminating the Competition at any time without compensation.

7.4 The competition is organised by Fantasy Cards s.r.o. on its initiative.

7.5 These Competition Terms are valid from 23 June 2024.
